Terms of Service

1. Acceptance of Terms

By accessing or using Kynso ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. We may update these Terms from time to time — continued use after changes constitutes acceptance.

2. Description of Service

Kynso is a personal productivity application that provides:

  • Daily task tracking and management with carry-forward functionality
  • Habit definition, logging, and streak tracking
  • Goal and milestone tracking
  • Daily notes and rich-text journaling
  • Audio note recording and playback
  • Push notifications for reminders and alerts
  • Multi-profile support for separate areas of life

The App is provided as a web application accessible through modern web browsers. We may add, modify, or discontinue features at any time.

3. Account Registration

  • You must provide a valid email address to create an account, or sign in with Google or Apple.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 13 years old to use the App.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate and complete information when registering and to keep your account information up to date.
  • You must not create accounts for the purpose of abusing the App's functionality or other users.

4. Your Content

  • You own your content. All tasks, notes, habits, goals, milestones, and audio recordings you create belong to you.
  • We do not access, use, analyze, or share your content except as necessary to provide the App's functionality.
  • You grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of operating the App.
  • We do not use your content to train machine learning models, for advertising, or for any purpose other than providing the service to you.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or to store illegal content
  • Attempt to gain unauthorized access to other users' accounts or data
  • Interfere with or disrupt the App's services, servers, or infrastructure
  • Use automated means (bots, scrapers, crawlers) to access the App
  • Reverse-engineer, decompile, or attempt to extract source code from the App
  • Circumvent any security measures or access controls
  • Transmit any viruses, malware, or other harmful code
  • Resell, sublicense, or commercially exploit the App without our written consent

6. Free & Paid Services

Kynso offers a free tier with core features and an optional paid subscription ("Kynso Pro") that unlocks additional capabilities such as unlimited profiles, unlimited habits, photo attachments, audio memos, and more.

  • Free features remain available without a subscription.
  • Pricing, billing, and subscription terms are clearly presented before you are charged.
  • You will not be charged without your explicit consent.

7. Subscriptions & Auto-Renewal

If you subscribe to Kynso Pro, the following terms apply:

  • Free trial: New subscribers may receive a 7-day free trial. You can cancel at any time before the trial ends without being charged. If you do not cancel before the trial expires, your subscription will automatically convert to a paid subscription.
  • Auto-renewal: Subscriptions automatically renew at the end of each billing period (annual) unless you cancel at least 24 hours before the end of the current period.
  • Payment: Payment is charged to your Apple ID account, Google Play account, or payment method on file (for web) at confirmation of purchase and at the start of each renewal period.
  • Cancellation: You may cancel your subscription at any time:
    • iOS: Settings > [Your Name] > Subscriptions > Kynso Pro
    • Android: Google Play Store > Payments & subscriptions > Subscriptions > Kynso Pro
    • Web: Kynso Settings > Manage Subscription
  • No refunds: Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time, except as required by applicable law or the policies of the Apple App Store or Google Play Store.
  • Price changes: We may change subscription pricing with reasonable notice. Any price change will take effect at the start of your next billing period after the change.

8. Service Availability

We strive to keep the App available 24/7, but we do not guarantee uninterrupted availability. The App may be temporarily unavailable due to:

  • Scheduled or emergency maintenance
  • Software updates and deployments
  • Circumstances beyond our control (infrastructure outages, natural disasters)

We are not liable for any loss or damage resulting from temporary unavailability of the App.

9. Intellectual Property

The App, including its design, code, branding, logos, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

Your user-generated content remains yours. We claim no intellectual property rights over the content you create within the App.

10. Termination

  • You may delete your account at any time from the App's Settings page.
  • We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or pose a security risk.
  • Upon termination, your data will be permanently deleted from our systems in accordance with our Privacy Policy.
  • Sections regarding intellectual property, disclaimers, and limitation of liability survive termination.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, secure, or uninterrupted.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from or relating to these Terms or the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $100 CAD, whichever is greater.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising from these Terms or the App shall be resolved in the courts located in the Province of Ontario, Canada.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We will update the "Last updated" date at the top of this page and, for material changes, may notify you via email or in-app notification.
